Flight Delay Claims

Was Your Flight Delayed, Cancelled or Overbooked in the last 6 Years?

Were You Delayed More Than Three Hours?

Act Now and Claim up to €600 in Compensation with Barings Solicitors.

Barings Solicitors are experienced in recovery compensation for clients who have experienced delays whilst travelling with airlines. We utilise the law to fight for your rights and in particular EU Regulation 261/2004. It establishes rules on flight delay compensation for passengers in the event of denied boarding, flight cancellation or delayed flight. The regulation was created in 2004 and enforced on 17 February 2004, and applies to all members of the EU and the airlines that reside within them.

To be eligible under EU Regulation 261/2004, you must have a confirmed reservation on the flight and arrived on time for check-in. You can claim against the airline as your rights are protected as a traveller, the compensation you are entitled to depends on which of the following you’ve experienced:

Regulation 261/2004 protects your airline rights and states that you, as a traveller, are entitled to flight delay compensation in the following scenarios:

  • A delayed flight by three or more hours
  • A cancelled flight
  • An overbooked flight

Barings Solicitors have faced a wide range of alleged reasons from airlines as why they should not compensate you. We have won compensation for our clients in the following situations which fully protected by the EC Regulation 261/2004:

  • Technical Faults
  • Adverse Weather
  • Claim was over 2 Years Ago
  • Air Traffic Control Restrictions
  • Runway Restrictions
  • Knock On Flight Delays
  • Airline Crew were Sick or Over Hours
  • Transport Bus was Late
  • Denied Boarding due to an Overbooked Flight

What am I entitled to?

The amount of fixed compensation for cancelled, overbooked, or delayed flights ranges from €250 to €600 per passenger, as it varies according to the length of delay and distance of your flight.

Your owed flight delay compensation is in addition to extra entitlements, which should include:

  • Meals
  • Refreshments
  • Overnight accommodation (if applicable)
  • Transport to and from accommodation

There are certain exceptions under which compensation is not due. These so called extraordinary circumstances imply that airlines cannot always be held accountable, for instance, when a situation is beyond their control.

The following situations are considered extraordinary:

  • Freak Weather Conditions
  • Political Unrest, Terror Attacks, Security Risks
